By StitchMagic team · Last checked and updated 23 October 2026

You register a trade mark in India by filing Form TM-A with the Trade Marks Registry (IP India), one fee per class per mark: ₹4,500 on e-filing for an individual, startup or small enterprise, ₹9,000 for everyone else. Registration is valid for 10 years from the application date and renews for 10 years at a time. Fees are from IP India's schedule under the Trade Mark Rules 2017, checked 22 Oct 2026.

Trademark registration fees in India

The official fee to apply is ₹4,500 per class per mark on e-filing if you are an individual, startup or small enterprise, and ₹9,000 in all other cases; filing on paper costs ₹5,000 and ₹10,000. “Per class” matters: an individual filing her label in two classes pays ₹9,000 on e-filing. A trade mark is a sign that can be shown graphically and tells your goods apart from someone else's; words, names and letters all qualify. A proprietor selling kurtis under her own label pays the first column; a private limited company that is not a small enterprise or startup pays the second.

Trademark classes

Goods and services are grouped under the Nice Classification: classes 1–34 cover goods and 35–45 cover services, 45 in all. File in the class of what you actually sell. One application can name more than one class, and each class is paid for separately.

Used or proposed to be used

You can file a mark you have not used yet (“proposed to be used”) or claim prior use. Claiming use needs a user affidavit with supporting documents, per IP India's basics of trademarks (checked 22 Oct 2026).

How to register a trademark in India

These are the Registry's own stages, from IP India's trade mark application workflow (checked 22 Oct 2026). IP India publishes no fixed time for each stage, so we give none.

  1. 1

    Search the name first

Search your brand name, and close spellings of it, in IP India's public trade mark search, in the class you plan to file in.

You should see: A list of existing marks that match or come close. A near-identical mark in your class is a reason to rethink before you pay.

  2. 2

    Pick the class or classes

Decide which of the 45 classes cover what you sell; goods are 1–34, services 35–45.

You should see: A short list of class numbers, each one a separate fee on the form.

  3. 3

File Form TM-A on e-filing and pay

Log in to IP India e-filing, fill Form TM-A for your mark and its classes, and pay ₹4,500 or ₹9,000 per class.

You should see: An application number. Keep it for the e-status page.

  4. 4

    Formality check and examination

The Registry checks the filing for gaps (it sends a deficiency note if something is missing), codifies logos under the Vienna system, then examines the mark and issues an examination report. Reply to any objection, or attend a show-cause hearing if one is fixed.

You should see: The application is accepted, or refused if the objection stands.

  5. 5

    Publication and opposition

An accepted mark is published in the Trade Marks Journal. An opposition may then be filed on Form TM-O; if one is, opposition proceedings follow.

You should see: No opposition, or an opposition decided in your favour.

  6. 6

    Registration and renewal

The mark is registered. It stays valid 10 years from the application date; renew it on Form TM-R for ₹9,000 per class on e-filing.

You should see: The mark shows as registered, with renewal due 10 years after you applied.

Trademark status and fees: what we checked on IP India (22 Oct 2026)

To check trademark status, enter your application number on IP India's e-status page, tmrsearch.ipindia.gov.in/estatus, which returned a working page when we checked on 22 Oct 2026. We opened each official page a seller needs; this is what each one gave us.

That last row matters because some trademark guides still link the old fee page. If a fee table you are reading points there, check its numbers against the current schedule.

Trademark registration mistakes sellers make

The costly mistakes are the wrong class, the wrong fee column and a missed renewal; each one ties to an IP India rule or fee (checked 22 Oct 2026).

  • Filing in the wrong class, or only one. Each class is named and paid for separately, so list every class you actually sell in.
  • Skipping the search. The public search comes before any fee is paid; an objection after filing has to be answered.
  • Paying from the wrong column. ₹4,500 is for an individual, startup or small enterprise; other applicants pay ₹9,000 per class on e-filing.
  • Missing the renewal. IP India says failure to renew may get the mark removed from the register; the TM-R fee is ₹9,000 per class on e-filing.
  • Calling a filed mark “registered”. A filed application still has to pass examination, publication and any opposition.

This is a summary for sellers, not legal advice. For objections, oppositions or hearings, use a registered trade mark agent or attorney.

Do you need a trademark to sell online?

Myntra lists an “Original Trademark Certificate or Authorisation Letter / NOC on brand owner's letterhead” among its seller documents, per its partner portal FAQ (read 3 Oct 2026), so you need your own registration or the brand owner's authorisation. AJIO asks for a brand trademark registration certificate, or a trademark registry or brand authorisation document (seller FAQ, 4 Oct 2026). We do not claim any such rule for Meesho, Flipkart or Amazon. Selling your own label on Myntra? Start with selling on Myntra and the Myntra seller login guide; AJIO is covered on selling on AJIO. Registering the business itself is in the Udyam registration guide, and more guides sit under tools for marketplace sellers.
